Avery spat gets ugly
Sean Avery is preparing to file a libel charge against a Toronto radio personality who reported yesterday that Saturday's pregame skirmish between the Rangers' winger and the Maple Leafs' Darcy Tucker was incited by Avery referring to Jason Blake's cancer condition, The Post has learned.
Advised by his attorney to decline public comment, Avery has privately denied the charge as broadcast by Howard Berger over The Fan 590.

I haven't seen anything by Berger that explicitly states that Avery's trash talk had anything to do with Blake's condition. The only thing I heard on the radio is that a Ranger player told him that he wanted to 'ring Avery's neck himself'.
Can Berger be held responsible for what the majority of people will deduce themselves?

Douchebag would have to A: prove his reputation was damaged and B: quantify the damages.
Berger's got a pretty good defence that Douchebag had no reputation to damage.
